Terms of Service

These Terms of Service ("Terms") govern your access to and use of fp-institute.com (the "Site") and the private area at app.fp-institute.com (the "App"), both operated by SP Legacy Ltd, a company registered in England & Wales under number 14788718, trading as FP Institute.

By accessing the Site or the App, you agree to be bound by these Terms. If you do not agree, please do not use them.

FP Institute is a specialist educational publisher of FE (Fundamentals of Engineering) exam preparation books. Through the Site and the App we make available:

• ·Informational pages about our books, our methodology, and our endorsing Licensed Professional Engineers;
• ·Landing pages with optional email opt-in to receive free study guides and downloadable resources;
• ·A private area (the App) accessible to readers who have purchased an FP Institute book and activated their account through the QR code printed inside the book. The private area unlocks access to the CBT Exam Simulator and the Digital Workbook for the relevant discipline.

3. Purchases of books

FP Institute books are sold through Amazon. Your purchase contract for the book itself is concluded with Amazon and is governed by Amazon's own terms, including its returns and refunds policy. SP Legacy Ltd is not a party to that contract.

Activation of the digital companion tools (CBT Simulator and Digital Workbook) is included with every legitimate copy of the book and is provided directly by SP Legacy Ltd under these Terms.

4. Account registration and access

• ·To access the App you must create an account by scanning the QR code printed inside your FP Institute book.
• ·You must provide accurate information when you register and keep it current.
• ·You are responsible for safeguarding your password and for any activity that occurs under your account.
• ·Accounts are personal and non-transferable. Sharing credentials with third parties is not permitted.
• ·You may request deletion of your account at any time through our contact form.

5. Acceptable use

You agree not to:

• ·Use the Site or the App for any unlawful purpose or in any way that infringes the rights of others;
• ·Copy, reproduce, distribute, scrape, or republish any content from the Site, the App, or the books, except as expressly permitted by law (e.g. quotation for educational review) or by these Terms;
• ·Reverse-engineer, decompile, or attempt to extract the source code of the CBT Simulator or the Digital Workbook;
• ·Interfere with the security, integrity, or availability of our infrastructure;
• ·Use any automated means (bots, scrapers) to access the Site or the App, other than search engine crawlers operating in accordance with robots.txt.

6. Intellectual property

All text, design, illustrations, code, and other materials on the Site and in the App are the property of SP Legacy Ltd or its licensors and are protected by UK and international copyright, trademark, and other intellectual property laws.

FP Institute and the FP Institute seal are trademarks of SP Legacy Ltd.

NCEES®, FE, and Fundamentals of Engineering are registered trademarks of the National Council of Examiners for Engineering and Surveying. SP Legacy Ltd is not affiliated with, endorsed by, or sponsored by NCEES®.

Use of these Terms grants you a personal, non-exclusive, non-transferable licence to access the Site and to use the App for the purpose of preparing for the FE exam. No other rights are granted.

7. No exam outcome guarantee

Our books and tools provide structured preparation aligned to the NCEES® Reference Handbook. Outcomes on the FE exam depend on individual study effort, time invested, prior preparation, and factors outside our control.

We make no guarantees about exam outcomes. We do not collect, calculate, or publish pass-rate claims about our customers. Any statement that you will pass the FE exam by using our materials is not authorised by us and is not part of these Terms.

8. PE endorsements

Each of our books carries a foreword and endorsement by a Licensed Professional Engineer in the relevant discipline. These endorsements reflect the independent professional opinion of the endorser, given under a formal foreword agreement with SP Legacy Ltd.

They do not constitute an endorsement by NCEES®, by any state licensing board, or by any other regulatory body.

9. Service availability

We aim to keep the Site and the App available with high reliability, but we do not guarantee uninterrupted availability. We may perform maintenance, apply updates, or temporarily suspend access for security or operational reasons. Where reasonably possible, we will provide advance notice of planned downtime.

10. Disclaimers

The Site, the App, the CBT Simulator, the Digital Workbook, and all other materials are provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site or the App will be error-free, secure, uninterrupted, or that any content is accurate, complete, or up to date at all times.

11. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law.

Subject to the above, to the maximum extent permitted by law, SP Legacy Ltd, its officers, directors, employees, and processors will not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, goodwill, or anticipated savings, arising from or in connection with your use of the Site, the App, or our books.

Our total aggregate liability to you in any 12-month period, for any cause of action arising from these Terms, shall not exceed the amount you paid (if any) for direct purchases from SP Legacy Ltd in that period, or GBP 100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless SP Legacy Ltd, its officers, directors, employees, and processors from any claim, demand, or liability (including reasonable legal fees) arising from (i) your breach of these Terms, (ii) your misuse of the Site or the App, or (iii) your violation of any law or third-party right.

13. Termination

We may suspend or terminate your access to the Site or the App at any time, with or without notice, if we reasonably believe you have breached these Terms or acted in a way that may harm us or other users. You may stop using the Site and the App at any time and may request deletion of your account through our contact form.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Material changes will be highlighted on the Site for at least 30 days from publication. Continued use of the Site or the App after the changes take effect constitutes acceptance of the updated Terms.

15. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. Subject to mandatory consumer rights you may have in your country of residence, the courts of England and Wales shall have exclusive jurisdiction.
